Cypriot retailers concerned about watchdog complaint

The Cyprus Petrol Station Owners Association has strongly criticised the Commission for the Protection of Competition (CPC) for rejecting its complaint, raising serious questions about how competition law complaints are handled in Cyprus.

The association said its April 2023 complaint included 331 pages of documentation, followed by an additional 788 pages of clarifying evidence.

However, the CPC rejected the complaint on December 13, citing insufficient evidence without providing supporting arguments for this position, according to the association.

The group emphasised that the CPC had access to previous data from its own investigations documenting exclusive supply agreement clauses but failed to utilise this information adequately.

The association also claims the CPC questioned calculations regarding minimum retail-wholesale price margins but then dismissed the data as unrealistic without allowing the group to respond.

The association stressed that proving violations should be based on data from oil companies’ self-managed stations, which it argues the CPC should seek through preliminary investigations.
